Terms and Conditions

1. Introduction

1.1 By accessing or using the Services, you agree to these Terms. Quest is a product of Canine Safaris Ltd, incorporated in Uganda under the Companies Act, 2012. Canine Safaris LLC (New Mexico, USA) acts as billing affiliate where applicable.

1.2 If you accept on behalf of an organization, you represent that you have authority to bind that entity. Electronic acceptance is a binding agreement under the Electronic Transactions Act, 2011 (Uganda).

2. Eligibility and Registration

2.1 You must have legal capacity to contract and provide accurate registration information. Quest may require identity, company, regulatory, or tourism-sector verification.

2.2 You remain solely responsible for licenses and permits required for your tourism business under the Uganda Tourism Act and other applicable law.

3. Service Description

3.1 Quest provides digital tools including quote creation, itinerary and pricing management, destination and supplier data, customer records, PDF delivery, website embeds, bookings-related workflows, analytics, and support for tour operators.

3.2 We may add, modify, or withdraw features, subject to applicable commercial terms and law for paid committed periods.

4. Acceptable Use

4.1 You shall use the Services lawfully and shall not submit false or infringing content, attempt unauthorized access, interfere with security or performance, upload malware, process personal data without authority, violate consumer or competition rules, or resell the Services without written authorization.

5. Accounts and Security

You are responsible for credential confidentiality and all activity under your account. Notify Quest promptly of suspected compromise or unauthorized use.

6. Fees and Billing

6.1 Paid access is subject to fees under a subscription plan, order form, or quotation. Standard Quest Pro fees are billed in UGX as shown on the pricing page and Subscription Agreement, exclusive of taxes and bank charges unless mandatory law requires otherwise.

6.2 Canine Safaris LLC may invoice, collect payments, and administer renewals on behalf of Canine Safaris Ltd.

7. Trials and Promotions

7.1 Quest may offer trials, pilots, or promotions. New accounts may receive a thirty (30) day full-access trial as described on the pricing page unless otherwise stated.

7.2 Trials convert to paid plans only when you subscribe or where auto-conversion was clearly disclosed and consented to at sign-up.

8. Intellectual Property

Quest and its licensors retain all rights in the Services, software, and content except User Data you supply, subject to the license you grant Quest to host and process that data. Platform content is protected under Ugandan copyright and industrial property law.

9. Privacy

Personal data is processed under our Privacy Policy and the Data Protection and Privacy Act, 2019 (Uganda). Cookies are described in our Cookie Policy.

10. Third-Party Services

The Services may integrate payment gateways (including Stripe), analytics (PostHog and, with consent, Google Analytics), cloud hosting (Vercel), identity providers (Google sign-in), and other tools. Quest is not responsible for third-party products except as expressly agreed in writing.

11. Suspension and Termination

Quest may suspend or terminate access for security, fraud, unlawful conduct, material breach, non-payment, or platform protection. Fees already paid are generally non-refundable except as required by law or stated in the Subscription Agreement.

12. Warranties and Liability

Except as expressly stated, the Services are provided "as is" and "as available". To the maximum extent permitted by law, Quest disclaims implied warranties and limits liability for indirect damages. Aggregate liability is capped as set out in the Terms of Service or twelve (12) months of fees paid for the affected Services.

13. Governing Law and Disputes

These Terms are governed by the laws of Uganda. Parties shall seek amicable resolution first; unresolved disputes may be referred to arbitration in Kampala under the Arbitration and Conciliation Act unless agreed otherwise in writing.

14. Changes

Quest may amend these Terms with notice through the Services or registered contact details. Continued use after the effective date constitutes acceptance where permitted by law.
